The Democrats gutted the Parents Rights Initiative this session. 

The Secretary of State recently undermined the people’s right to referendum.

I’m fighting against those 2 injustices.

On April 28, I filed a referendum which would empower the voters to VETO the legislature’s changes to the Parents Rights Initiative (restoring the law to the way it was as originally written and passed).

For Referendum 108 to qualify for the November ballot, the law and the Constitution guarantee us 90 days to collect 154,000 valid voter signatures. Deadline is July 27.

The law required the Secretary of State to transmit the referendum to the AG for a ballot title.

But Steve Hobbs ignored that law.

So I filed a Recall Petition against him (more on that another day).

And I also filed a Writ of Mandamus with the state supreme court — read it here — asking them to order Steve Hobbs to follow the law and transmit the referendum to the AG for a ballot title:  

I was notified that the supreme court commissioner would take up my case on June 18.

I subsequently scored 2 preliminary victories:

* On May 2, I filed an Emergency Motion for Expedited Consideration to speed things up. On May 9, my motion was GRANTED.

This matter is hereby stricken from the Court Commissioner’s June 18, 2025, motion calendar and re-set for expedited consideration on his June 4, 2025, motion calendar.

* After winning that motion, I filed a Motion for an Expedited En Banc Hearing (asking that the case be decided by all 9 judges, not the commissioner). On May 12, I received this: 

So now the entire bench will decide the case. 

Since I’m not a lawyer, I’m really encouraged by these 2 preliminary victories. 

The people deserve to vote on restoring the Parents Rights Initiative.

And it’s critical for the people’s constitutional right to referendum be protected (not just this referendum but for all future referendums).
