Well, it turns out that the 8th Amendment to the US Constitution makes it illegal for the government to impose an “excessive fine” on an individual citizen.
And a central criteria to determine “excessiveness” is the person’s ability to pay.
Is an $8 million penalty excessive for someone who has nothing?
You’d sure think so.
In 2021, the judge didn’t allow any evidence to be entered into the court record regarding my (awful) financial situation.

He imposed a massive penalty (increasing 12% per year).
When the case was appealed, the higher court ruled that the judge errored by not accepting such evidence.
And ordered there be a new hearing on it.
Last Friday, my brilliant attorney Richard Sanders — a man deserving of sainthood — filed his motion about it.
