I found out about this morning’s hearing late last night – so I didn’t have the chance to invite all of you to join me in testifying against it. But your emails you send TODAY will help A LOT.

Here are my remarks I prepared before the hearing:
My name is Tim Eyman from Bellevue.
I strongly oppose this bill. You’ve forgotten that it is the voters’ pamphlet, not the politicians’ pamphlet.
It is for the voters.
Voters are 18 and older so we’re talking about adults who are reading and considering supporters’ and opponents’ arguments on ballot measures and candidate arguments.
House Bill 1272 is pure censorship.
It micromanages what can and can’t be said by regular citizens in state and local voters pamphlets. And disturbingly, it gives unlimited power to the Secretary of State and county auditors to be the truth arbiters and civility referees.
In 2007, the state supreme court struck down a censorship law just like this one.
The Court was clear: “The notion that the government, rather than the people, may be the final arbiter of truth in political debate is fundamentally at odds with the First Amendment.”
The American Civil Liberties Union said “the law wrongly tried to put the government in the position of trying to determine what was true or false in campaign statements, and that doesn’t work.”
Voters learn about initiatives in the voters pamphlet — each side gets an equal number of words — that’s fair. But this bill censors what each side can say about the initiative. That’s censorship.
When I ran for Governor, I called out Jay Inslee by name in my voters pamphlet statement but some county auditors sought to censor me.
Some said they would not allow any statement from me to appear in the voters pamphlet if I didn’t protect Jay Inslee.
Here’s a portion of what I wrote for the voters pamphlet:
“As Governor, my mission will be to fix Washington’s broken system.
“Imagine if Jay Inslee hadn’t betrayed voters by breaking his campaign promises to veto taxes, raising them 30 times instead. “
“Imagine if Inslee hadn’t recklessly shut down thousands of small businesses, forcing a million people out of work, while letting mega-corporations remain open.
“Inslee’s lockdown spared his allies but punished everyone else.
“Inslee’s actions always benefit the special interests that bankroll him.
“Inslee admitted he’s exploiting the economic crisis to raise your taxes – he wants carbon taxes, income taxes, and a creepy Pay-Per-Mile-Tax. I’ll block all tax increases.
“Inslee betrayed you. Trust me with your vote and I promise I will fight for you.”
Who was harmed by me speaking the truth about Jay Inslee in the voters pamphlet?
No one.
I believe that as a candidate, I had the First Amendment right to tell voters about Jay Inslee’s many failures.
And I trusted the voters to decide.
This bill doesn’t trust voters at all.
It censors what candidates and ballot measure participants can and can’t say and sets vague standards that are subject to multiple interpretations which leaves the government in the position to choose what can and can’t be printed and expressed in state and local voters pamphlets.
That is dangerous.
It clearly infringes on the rights of the regular people to express their opinions on issues and candidates.
