The legal counsels for all the parties in Jim Walsh’s lawsuit, including the AG, had no objection to me filing an amicus.
So I filed it.
But the next day after reading it, the AG did a switcheroo & objected.
So now, my amicus — which exposed the AG’s sabotage of these 3 initiatives — has been rejected.
Can a regular citizen expose Bob Ferguson for the fascist he is?
I just did.
A fascist “suppresses opposition and criticism.”
That’s clearly what he’s doing here.
“Now having seen your proposed brief, the State objects … your proposed brief is almost entirely focused on whether the PIID statute is good policy or unconstitutional and whether the PIIDs issued for 2109, 2117, and 2124 are biased.”
That’s exactly right.
It’s why I wrote it.
It’s why I filed it.
But here’s the REAL REASON Ferguson insisted on blocking it.
In addition to filing my amicus brief, I was also required to file what’s called a “Motion for Leave to File” — which I did.
Here are the portions that Fascist Fergie didn’t want published, publicized, and to be forced to respond to:
“The arguments raised in the proposed amicus brief present important considerations which merit the Court’s attention in understanding the implications of resolving this case, chiefly, the clear corruption of the official ballot titles for these 3 initiatives with PIIDs by the Attorney General.
“My proposed amicus brief will assist the Court in understanding the collateral consequences of allowing the AG to sabotage these 3 initiatives with PIIDs that violate the longstanding law that require that initiative ballot titles not ‘create bias either for against the measure.’
“I am well-positioned to provide useful input on the underlying First Amendment analysis from the perspective of all sponsors of initiatives and the chilling effects that PIIDs will have on the people’s right to initiative guaranteed by our state’s Constitution.
“The proposed amicus brief will also highlight the actual wording of the PIIDs for these 3 initiatives that will clearly show how obviously biased they are and how violative they are both legally and constitutionally.
“The implications of this case extend far beyond these 3 initiatives. Allowing the AG to put his heavy thumb on the scale and corrupt the official ballot titles for all tax-and-fee initiatives with loaded biased verbiage is both illegal and unconstitutional.
“And if allowed to do this to ballot titles for tax-and-fee initiatives, it opens the door to the AG corrupting the official ballot titles for initiatives on any topic.
“These points should be considered in the Court’s analysis and will be presented in my proposed amicus brief.”

It is beyond outrageous for Bob Ferguson to have such a blatant disregard for the First Amendment and our other constitutional rights.
I will continue to keep you updated on this critical battle to save Jim Walsh’s 3 initiatives from the AG’s sabotage.
