For 110+ years, our state Constitution has guaranteed the people the right to the initiative process.

Since 1999, there have been 70+ ballot measures that have collected enough voter signatures to have a public vote.

Voters passed 24 liberal initiatives and 20 conservative ones so both sides use the initiative process and both sides will never be able to use it again if these destructive anti-initiative bills pass.

Since 1999, 25 million voter signatures were turned in to the Secretary of State AND NOT ONCE HAS A FORGED SIGNATURE ever been counted.

Not even one. 

In the past 10 years, not once has a fraudulent or forged signature even been turned in to the Secretary of State. 

This isn’t a problem in Washington state. 

So what is the reason the Democrats are giving to push these anti-initiative bills?

To find forged signatures THAT DON’T EXIST!

HB 2260 — requires the Secretary of State to reject perfectly valid voter signatures if the voter signing the petition doesn’t include their address or the circulator doesn’t fill out the back of the petition. Secretary of State Hobbs and Secretary Sam Reed came out strongly against this last year:

Under this bill, the Secretary of State’s top priority will be to take petitions filled with perfectly valid voter signatures AND THROW THEM IN THE GARBAGE.

Now check out the insanity these new anti-initiative bills require: 

HB 2259 / SB 5973:  

1) Both bills prohibit initiative campaigns from paying anyone to collect signatures DIRECTLY OR INDIRECTLY based on how many signatures they collect. The 1993 Legislature already tried to do this (HB 1645) and the court immediately struck it down for violating the First Amendment (LIMIT v Maleng).

Plaintiffs showed that initiative campaigns that pay-per-signature had better validity rates that those collected by unpaid volunteer campaigns (that’s still the case — since 1999, the average invalid rate for pay-per-signature campaigns was 17.4% while the average invalid rate from unpaid volunteer campaigns was 23.2%).

HB 2259 / SB 5973 also require this:

2) Before an initiative or referendum could even be filed, both bills require the sponsor to first collect 1000 voter signatures, submit them to the Secretary of State, require the Secretary of State to verify the 1000 are valid, and if they are, only then will the sponsor be allowed to file their initiative, have the Secretary of State process it, have it reviewed by the Code Revisor, and receive a ballot title from the Attorney General. The signature drive could not begin until the sponsor jumped through all those hoops. This would certainly run out the clock on any referendum (which only has 90 days to collect signatures) and it would take away MONTHS from any initiative to the people signature drive that is already limited to 4 months assuming they start on day one (which many do not).

The Secretary of State’s filing fee increase (going from $5 to $156) has already reduced the number of measures being filed which is the justification for the 1000 signature requirement. Oregon mandates this but that state allows 2 years to collect signatures so it’s a totally different situation.

These bills are totally unnecessary.

They’re a solution in search of a problem.

I urge EVERY LEGISLATOR to reject SB 5973 and HB 2259 and HB 2260 because they DESTROY the People’s Initiative Process.  

HB 2260 — Secretaries of State Steve Hobbs and Sam Reed testified forcefully against this last session. Petitions filled with perfectly valid voter signatures should not be thrown in the garbage because the voter signing the petition didn’t include their address or the circulator didn’t fill out the back.

HB 2259 & SB 5973 — since 1999, over 25 million voter signatures have been turned into the Secretary of State and not a single forged signature has ever counted. In the past 10 years, the Secretary of State hasn’t even seen a questionable signature (and if he had, it wouldn’t have counted anyway). Requiring sponsors to collect 1000 signatures before they can even file their ballot measure accomplishes nothing.

Since 1999, 70 ballot measures have turned in enough signatures to qualify for the ballot — voters passed 24 liberal initiatives and 20 conservative ones. The initiative process is for everyone. Both sides use it and both sides will never be able to use it again if these bills pass.

I ask you to actively oppose and speak out forcefully against these destructive anti-initiative bills.

The initiative process is ours, not yours, leave it alone.
