What can a regular citizen do?

I ask myself that question every day.

Right now, the AG is trying to sabotage Jim Walsh’s 3 initiatives (I-2109 Inslee’s Capital Gains Income Tax, I-2117 Inslee’s Cap & Trade Scheme, and I-2124 Inslee’s Long Term Insurance Scam).

Jim Walsh filed a lawsuit against the AG on this attempted sabotage.

It’s being heard by the state supreme court in August.

His attorney — Joel Ard — wrote a brilliant legal brief.

In it, he argued the AG’s sabotage shouldn’t be allowed for these 3 initiatives.

I don’t think the AG’s sabotage should be allowed for any initiative.

So I decided that I knew enough about this that I would write and file a legal brief — called an AMICUS CURIAE — with the state supreme court.

“An amicus curiae is an individual or organization that is not a party to a legal case but is permitted to assist the court by offering information, expertise, or insight related to the issues in the case.”

I didn’t hire an attorney to do it for me — I did it myself (having no money gave me no other option).

I wrote it this week and filed it today.

I’ve seen a lot of them over the years but this is the first time I’ve ever done an amicus myself.

In 2022, the Democrats passed House Bill 1876 that allows the AG to insert a sabotage sentence — a “public investment impact disclosure” (PIID) — into the official ballot title for an initiative.

But longstanding law requires that any ballot title be neutrally worded so that it doesn’t“create prejudice either for or against the measure.”

The AG drafted and filed the neutral wording for the official ballot titles for Jim’s initiatives in 2023.

That exact wording is what must appear on voters’ ballots — THEY SHOULD NOT BE ALLOWED TO BE REWORDED BY THE AG.

But Ferguson says his sabotage sentences — his 3 PIIDs — are “not part of the ballot titles.”

As I wrote in my amicus:

“The AG’s official ballot titles have been corrupted by the AG’s PIIDs and are, in fact, part of their ballot titles.

Abraham Lincoln’s well-known riddle applies here: “How many legs does a dog have if you call his tail a leg? Four. Saying that a tail is a leg doesn’t make it a leg.”

Saying a PIID isn’t part of the ballot title when it appears in the ballot title doesn’t stop it from being part of the ballot title.

The state supreme court will make its’ decision on August 9th.
