Richard Sanders is a brilliant, courageous attorney (and former state supreme court justice).

I am truly blessed to have him fighting back against Bully Bob Ferguson in this case.

For me and my family, it’s been 11+ years of investigation, litigation, and persecution by the AG.

At one point, in early 2019, the AG bullied one of my previous attorneys off the case.

And so, for around 9 months in 2019, I was forced to defend myself without a lawyer.

I’m not an attorney — I’m a regular person.

I did the best I could.

But not surprisingly, I lost motion after motion because I had no idea what I was doing.

This put me in a deep hole.

My stress level was through the roof.

Because I had Bully Bob using the full weight and power of his taxpayer-funded office to try to crush me while I was unrepresented by legal counsel.

 

Lawyer after lawyer agreed that the AG’s case against me was fundamentally flawed and ridiculously unconstitutional.

But none were willing to take on the AG.

Until I asked Richard to step in.

Once he familiarized himself with the facts of the case, he quickly came to the same conclusion (that this whole thing is a farce) and without hesitation he took on the challenge of taking on the AG.

Richard’s courage literally saved my sanity.

And by taking on this case, Richard freed me from the cage of the courtroom, allowing me to return to what I was born to do: to keep fighting for the people in the political arena as an activist (and not just in Washington but in states all across our nation).

Richard is doing an incredible job.

Thanks to his top-notch briefing and exceptional oral argument, the Court of Appeals in their recent ruling said the lower court judge screwed up by never evaluating whether or not I had the ability to pay nearly $6 million in fines (the 8th Amendment to the US Constitution prohibits the government from imposing “excessive fines” and the US Supreme Court ruled that courts must evaluate the defendant’s “ability to pay” when deciding whether a fine is excessive).

So that part of the case has been “remanded” to the lower court for reevaluation (a huge victory).

The Appeals Court also struck down a couple of the AG’s injunctions on my First Amendment rights.

But Richard wasn’t satisfied with just those few victories.

So he filed a “Motion for Reconsideration” which forces the Court of Appeals to reevaluate their ruling and to strengthen the arguments that’ll be made as the case proceeds.

Richard’s Motion is thorough, logical, and persuasive — he did a superb job highlighting the flaws in the Court of Appeals’ ruling.

Most especially, he took on their validation of the lower court that I, Tim Eyman, am no longer a person — that I am now a court-designated “political committee.” Since political committees are prohibited from using any of the money they receive for “personal use”, then I am legally prohibited from spending money on food, shelter, etc.

So how someone supposed to live if you’re a political committee?

You can’t.

It is a financial death sentence.

It is something that has never happened in all of US history or Washington state history for an individual’s “person-hood” to be stripped away.

Thanks to those of you who have donated to my legal defense fund since Richard took over my case, his firm has received around 80% of the money they are owed ($403,114).

But even after factoring that in, their latest bill is $114,650.12.

As pricey as that is, consider that the AG has spent 6 times more than that — all of it taxpayer money — on the lawyers he’s assigned to go after me, Karen, and our kids and relatives.

Without your support for my legal defense fund, this brutally dangerous legal precedent never would’ve been challenged.

I urge you to help me survive this political persecution by donating to my legal defense fund so that Richard can get the AG’s ridiculously unconstitutional ruling overturned so this never happens to anyone else.
