          This morning, my closing argument was filed with the clerk and the court and served on the AG and Secretary of State — you can read the whole thing below.

           But the first few paragraphs really sum up what’s happening:

          The Secretary of State’s unilateral increase in the initiative filing fee has demonstrably deterred citizen participation already. Last year on April 10, there were 58 initiatives to the legislature filed with the Secretary of State. This year: only 3 have been filed. 

          If, as Petitioner suspects, the goal of the Secretary of State and the Attorney General is to stop Jim Walsh from once again qualifying six initiatives to the legislature, then it’s already happening. But they should be honest and call this what it is: “Stop Let’s Go Washington.”

          The Secretary of State’s ultra vires act is so beyond his authority, so unconstitutional, and so damaging to the people’s initiative power that granting this writ of mandamus is absolutely essential.

          Every day that goes by with this sky-high fee in effect results in permanent and irreparable harm to Petitioner, other initiative sponsors, and voters by delaying the filing and processing of initiatives to the legislature and significantly reducing the number of days available to collect signatures thus imperiling their qualification.

Eager for your feedback — I want to get better.

This Friday I’ll be in court standing before Judge Lanese.

And I wrote previously, I’ve done a lot of these but I still get really nervous because I’m not an attorney.

But knowing that so many of my friends are watching and praying for me gives me a great deal of strength and solace.

I am fully aware that every time I face off against this AG that it’s a David versus Goliath battle.

But with such limited resources available to me, I have no choice but to handle these challenges myself even though I’m not an attorney. 

The Secretary of State and the Attorney General are attacking Jim Walsh for successfully qualifying 6 initiatives to the legislature — an extraordinary accomplishment — and trying to stop him from ever doing it again.

But their assault on the initiative process hurts everyone because it means the voters will have fewer initiatives to support in the future. 

That’s why this case is so important.
