Ever since I filed my lawsuit challenging the AG’s sabotage of tax initiatives, I’ve been desperately trying to get superstar attorney Joel Ard to take it over.

He’s absolutely brilliant and would obviously do a much better job arguing the case, both in the legal briefs as well as oral argument. 

Me doing these legal challenges is always a last resort — I certainly do a better-than-average job compared to other non-lawyers — I even win some:

But it’s obviously better to have someone like Joel Ard handling the litigation.

In July, initiative sponsor Jim Walsh made the bold decision to hire Joel to challenge the AG’s sabotage of the 3 tax initiatives. 

Joel’s legal briefs were incredibly well-researched, well-argued, and persuasive (you can read one of them here). 

But in August, the state supreme court ruled against him on a technicality — they said he should have filed a Declaratory Judgment Motion, not a Writ of Mandamus.

But recently, the high court notified Joel that they had re-thought their position and will allow his legal challenge to proceed and be heard and decided on the merits.

THIS IS EXCEPTIONALLY GOOD NEWS — his case is in a much better position than my lawsuit is.

Joel decided not to take over my case because he believes the best chance for success is with the original case which again, is already before the state supreme court. 

I am beyond thrilled with this important development.

TODAY’S HEARING IS CANCELLED

With Joel’s original lawsuit, I tried to file an amicus brief.

But the AG objected and was denied.

So in July, I filed my own expedited lawsuit challenging the AG’s sabotage of Jim’s initiatives.

This was denied because the AG complained he wasn’t given enough time.

I was told to refile it under the normal court schedule.

Which I did — I filed again in October.

And it was better because I had developed even more compelling arguments why the AG’s sabotage should be struck down. 

Last Friday, I filed my closing argument.

I’ve been prepping all week and was ready to give my oral argument this morning.

But the judge ended up cancelling this morning’s hearing because he decided the case based on the written briefs, denying my motion.

My immediate reaction: I was disappointed. 

But when I thought about it further, I realized that things turned out for the best.

All along I wanted Joel to handle this and the resurrection of his original legal challenge is now going forward.

So overall, it’s a NET PLUS.

For many months, I worked really hard and had to jump through a lot of hoops, but in the end, I got exactly what I wanted.

I can’t wait to watch him argue this before the state supreme court. 

I’ll make sure to keep everyone updated on this.
