In 2021, Inslee and the Democrats proposed a bill imposing a new capital gains income tax.
I and many others testified strongly against it.
It was and is a Pandora’s box.
It will inevitably lead to an income tax that hits all of us.
Despite overwhelming citizen opposition, the Democrats passed it anyway.
So we launched our signature drive for our initiative to ban any kind of income tax including the new capital gains income tax.
We worked really hard and promoted the heck out of it.
But we didn’t get enough signatures to qualify.
But fortunately, the voters had the chance to vote on it anyway with one of our tax advisory votes.
Voters said repeal it.
So what did the Democrats’ do in response to this rejection?
They ignored us and moved to block any attempt to eliminate it.
Knowing that there was going to be an initiative (and frustrated by voters repeatedly passing our tax initiatives over the past 27 years), the Democrats passed a bill in 2022 that sabotaged all future tax initiatives.
Here’s what they did.
For over 100 years, whenever a citizen files an initiative, the AG is required by law to write a neutrally worded description of its policies.
It’s called the ballot title.
So what the Democrats did was violate that neutrality law by empowering the AG to insert a sabotage sentence into the ballot title for any tax initiative that qualifies for a public vote.
No initiatives qualified for a public vote in 2022 or 2023.
So no one noticed the Democrats’ new law.
But as soon as superhero Jim Walsh qualified his initiatives, I knew this law was going to be a problem.
For my lawsuit, I am the Plaintiff and the Defendants are Bob Ferguson, the Secretary of State, and the Washington Legislature.
My lawsuit asks for a “Declaratory Judgment” finding that the Democrats’ law is illegal and unconstitutional and asks for a “Preliminary Injunction” which blocks the Secretary of State from including the AG’s sabotage sentences inside the neutrally worded ballot titles for Jim’s 3 tax initiatives.
And it prohibits them from doing it to all future tax initiatives.
Joel Ard’s lawsuit that was structured differently — he argued (very persuasively) that the Democrats’ law didn’t apply to Jim’s 3 initiatives.
Last Friday, the state Supreme Court ruled that that lawsuit wasn’t brought forth in the way they thought it should.
Their ruling read: “The Court unanimously determined that … (1) relief by prohibition is not appropriate … (2) appellants have adequate alternative remedies through actions for declaratory and injunctive relief.”
That is EXACTLY what my lawsuit asks for: “declaratory and injunctive relief.”
So this court hearing is a really big deal.

The AG’s sabotage sentences are inaccurate, biased, and clearly intended to sway voters to vote no.

It’ll last 30 minutes.
And then the judge will decide.
