This all has to do with the description that will be printed on voters’ ballots in November for Superstar Brian Heywood’s STOP ALL INCOME TAXES INITIATIVE (IP26-645).
511,408 voters signed petitions with the AG’s ballot title printed and prominently displayed on those petitions:

But after the initiative was certified, the AG added a warning label to the initiative’s description and wants that printed on voters’ ballots.
According to his court filings, liberal activist Arthur West signed and circulated a petition.
He is clearly PO’d the government is violating his right to petition (guaranteed by the First Amendment) and his right to initiative (guaranteed by WA’s Constitution) and objects — STRONGLY — to the law the Democrats passed in 2022 that allows them to change the wording of any tax initiative, including Brian’s.
When his legal challenge was first heard in lower court, the judge went bonkers and threw a hissy fit:

West appealed.
For three decades, I’ve followed A LOT of court challenges and read a jillion legal briefs.
But what happened this week — I’ve never seen anything like it.

Appeals are predictable:
The “Appellant” writes a Complaint and asks for relief (West did that).
The “Defendant” writes a Response (the AG did that).
And the Appellant answers that (West filed his on Monday).
Well, it was kind of a surprise that 4 interested parties wanted to weigh in on this so they each filed Amicus Briefs on Monday too.
An Amicus basically says: “hey there, justices, here’s my 2 cents on this.”
Things usually end there. The Appellant and Defendant usually say to themselves “we worked LONG hours drafting our briefs and WE’RE TIRED! Amicus’s? Ehh, ain’t worth our time.”
But the rules say Appellants and Defendants CAN write & file a Response to an Amicus.
They rarely do for the reasons stated above.
4 Amicus briefs were filed on Monday.
Today, JUST 3 DAYS LATER, West wrote Responses to not 1, not 2, not 3, but …
ALL 4 OF THEM!

Combined, they’re 15,908 words.

I’m “ALL IN” following this so yabetcha I’ve read ’em all (it took forever to get them off the state supreme court’s website – ugh!)
Let me assure you: they were NOT just slapped together — they are EXHAUSTIVE and THOROUGH.
I certainly don’t expect y’all to read all of ’em but I wanted to give everyone the option.
So here goes:
My Amicus was just 272 words.
West’s Response? 3161 words (click here to read it).

His brief was THOROUGH AND SERIOUS, but he did take a shot at me (Page 7: “But amicus’s brief, filed under a 5,000-word limit and consuming barely 300 of them, necessarily stops at the citation. FOOTNOTE: Appellant speculates that Mr. Eyman’s notorious and unique economic circumstances may have impacted his ability to fund a longer Brief.”)
I digress.
Back to it.
Richard Sanders’ brilliantly argued Amicus was 2998 words.
West’s Response? 4976 words (click here to read it).

The State GOP’s excellent Amicus was 995 words.
West’s Response? 2922 words (click here to read it).

Initiative Opponents’ anemic Amicus was 3634 words.
West’s Response? 4849 words (click here to read it — he absolutely BRUTALIZES them in it).

The court record is EXTRAORDINARILY FULL.
I told everyone the court will issue their decision tomorrow (Fri, Aug 21).
But given how EXTRAORDINARILY FULL the court record is, I will be SHOCKED if they do so. Seems much more likely they’ll hold off until next week.
This is a really big deal so I’m gonna do my best to keep everyone updated on this.
