SUPREME COURT CHALLENGE HEATS UP — lots of briefs filed — final decision expected Friday. Liberal activist Arthur West’s lawsuit has put a bright spotlight on Democrats’ efforts to sabotage tax initiatives, especially Brian Heywood’s Income Tax Repeal Initiative.

Well, things are moving lightning fast.
After this judge went nuts …

… the appeal to the state supreme court began.
Because the AG and Sec of State lied about the date a final ruling was due (they said August 21 but that turned out to be a lie — you can read about that here), the clerk scheduled an expedited briefing schedule.
So after his odd-ball rant, Cuckoo bird Judge Lanese …

… issued his “ruling” on Fri, Aug 7.
Liberal activist Arthur West wasted no time and filed his EMERGENCY MOTION FOR A PRELIMINARY INJUNCTION the following Mon, Aug 10. It’s 29 pages long, well researched, and very persuasive.
The AG filed their flaccid Response on Fri, Aug 14.
Then West filed his Reply to the AG on Mon, Aug 17.
But on that same day, there was a flurry of filings from other interested parties who wanted to weigh in (it’s taken me a while to get copies because the state supreme court’s website is taking forever to upload but I finally got ’em).
Most impressive was the Amicus Brief filed by former supreme court justice Richard Sanders.

Using trademark Sanders’ speak, he uses irrefutable logic filled with wit and wisdom:
“The AG argues this ‘illustrates how the PIID statute facilitates the initiative process;’ however if the information provided in a PIID is inaccurate or misleading it equally follows that its presence would obstruct it.
“It would be a ‘poison pill’ (which, let’s be honest, was exactly what the legislature intended.)”

Superstar lawyer Joel Ard filed an Amicus on behalf of the State GOP.

With a laser-beam focus, he annihilates the AG’s “warning label” scheduled to be inserted into the ballot title for Superstar Brian Heywood’s No Income Tax Initiative:
“A measure repealing a tax that no one has paid, nor will pay for three years, can only be described (under this law) as decreasing funding for services the tax has never funded. The Attorney General’s draft does exactly that, telling voters the measure ‘would decrease funding for public K-12 education’ etc. That is not neutral language … it is a warning of a cut that cannot occur, printed on the ballot beside the measure.”

And yes, no surprise, even I weighed in, filing an Amicus that simply cited a single US Supreme Court precedent:
“In Cook v Gralike, 531 U.S. 510 (2001), the United States Supreme Court unanimously ruled a constitutional amendment in Missouri requiring a warning label on ballots next to the names of candidates not supportive of term limits was unconstitutional because it sought to influence the results of elections.
“The Defendants in that case had argued such labels were just providing voters with additional information, id, at 525, just as Defendants argue in this case for the warning label set to be printed on voters’ ballots for Initiative IP26-645. The High Court unanimously rejected that argument. Id. So should this Court.”

Because of these Amicus briefs, now liberal activist Arthur West and the AG are allowed to file replies to each of them.
The court record will very well briefed.
Again, the state supreme court’s decision is expected on Friday.
This is a really big deal so I’m gonna do my best to keep everyone updated on this.
