There’s a longstanding law on the books that requires the Secretary of State to process ballot measures filed by citizens.

It’s a simple thing — a citizen pays the required filing fee and submits the wording for the measure, and the Secretary of State is supposed to assign it a number and send it onto the Attorney General to receive a short description (called a ballot title). Then the citizens can begin the process of printing petitions and collecting signatures.

As you know, last year, the Parents Rights Initiative was passed into law.

This year, despite our best efforts to stop them, the Democrats gutted the Parents Rights Initiative with House Bill 1296. 

On the people’s behalf, I protested against it at the bill signing:

There are 2 ways the Constitution guarantees the people the right to overturn injustices like this:

1)  With a referendum

2)  With an initiative

Ferguson signed HB 1296 into law on a Monday.  

On Tuesday, I filed a referendum to give the voters the chance to “voter veto” what he did. 

I paid the Secretary of State the filing fee but instead of processing it, Steve Hobbs violated the law by not forwarding the referendum to the Attorney General. So that blocked my referendum. 

When that happened, I filed a lawsuit and asked the court to order Steve Hobbs to follow the law.

Last week, the state supreme court issued its’ ridiculous ruling — they refused to order the Secretary of State to follow the law — click on the image below to watch this short video for a fuller explanation:

Being the annoyingly optimistic person that I am, I view this as a victory.

Why?

Because without the lawsuit, Hobbs would have quietly and privately gotten away with violating the law — I much prefer his lawlessness to be publicly exposed.

And without the lawsuit, the state supreme court would not have provided the people with yet another example of their corruption. 

Thankfully, heroic citizens like Brian Heywood and Larry Jensen saw this coming and filed initiatives to overturn HB 1296. 

Initiatives require TWICE the needed signatures (400K for an initiative, 200K for a referendum) but they still accomplish the same thing. 

We shouldn’t be forced to get DOUBLE the number of signatures but that’s where we’re at.
