Fighting for taxpayers for 29 years
First and foremost, the only reason we have the chance to vote on Initiative IP26-645 in November is because of one man:
BRIAN HEYWOOD

No Brian Heywood, no initiative.
He is the heroic sponsor, spokesman, and most fervent advocate for this critically important initiative. It prohibits state and local governments from imposing any kind of income tax and repeals the unconstitutional income tax the Democrats passed and Ferguson signed into law.

But don’t get me wrong: Brian DID NOT have the power to FORCE voters to sign petitions. He just organized the campaign to give voters the chance to.

Every person who signed did so VOLUNTARILY.
Every person who asked others to sign did so VOLUNTARILY.
And what did those 511,408 citizens sign?
They signed a petition that prominently displayed the official ballot title — written by the Attorney General — that describes the initiative’s policies.

That’s what we signed on to.
But in 2022, the Democrats passed a law that empowers the AG to add a Surgeon General’s warning label to any tax initiative that qualifies for the ballot.
And that certainly included Brian’s No Income Tax Initiative.
So the good guys challenged it.
The lower court judge went nuts:



So it was appealed to the state supreme court.
Both sides defended their positions.
4 Amicus Briefs were filed.
But the day before the Court was to take it up, without warning an unelected commissioner — suffering from delusions of grandeur — unilaterally decided HE was “not persuaded” and sided with the AG.
So everyone thought it was over, right?
Nope.
I went on the supreme court’s website to get these documents.
The following day an “EMERGENCY MOTION TO MODIFY THE COMMISSIONER’S RULING” was filed (something I’d never heard of). You can read it here:
That put the whole thing right back in front of the state supreme court again.

Yesterday, the AG filed their Response (you can read it here:). It was weak.
And filed today was this Reply to the AG (you can read it here: )
The clerk has set the hearing for Tues, Sept 1st.
Thanks to your 100’s of emails to the 9 justices …


… all 9 justices know that counties won’t print their ballots until mid-September so there’s plenty of time for the Court to make its decision.
This is a really big deal so I’m gonna do my best to keep everyone updated on this.
