In 2022, the Democrats passed a law that allows the AG to insert a sabotage sentence into an initiative’s neutral ballot title — but their sabotage legislation ONLY APPLIES to conservative initiatives.
Ya, I know, not shocking at all.
Jim Walsh sponsored and qualified 6 statewide initiatives — the Legislature passed 3 of them into law.
So there are 3 initiatives on the November ballot that the Democrats desperately want to sabotage.
And they have that law to do it.
But there’s a problem with their law — it only applies to initiatives that affect “taxes or fees”.
Back in May I wrote about this mortal threat to Jim’s initiatives and I asked all of you to send emails to Jim Walsh and his team asking them to hire superstar attorney Joel Ard to challenge this law.
GREAT NEWS — they did exactly that – they retained Joel to fight this critical battle.
I’m tellin’ ya, this guy is a superstar.

Here’s why I’m absolutely blown away by Joel’s legal skills.
In 2018, the Legislature sabotaged an initiative (they passed it into law, then they changed it, and then they blocked the public from voting on it — it was a super dangerous precedent).
I filed a lawsuit challenging it — you can read my opening brief here — Eyman v Wyman.
But soon after I filed it, Joel contacted me and volunteered to handle the case for free.
Long story short: all 9 justices on THIS state’s supreme court (!!!!!) agreed with Joel that what the Legislature did was improper / illegal / unconstitutional.
Thanks to Joel, we won.

The headline should have given credit where credit was due — Joel deserved the accolades.
Joel’s court victory in 2018 saved all future initiatives from this particular sabotage.
But in 2022, the Democrats came up with a new way to sabotage initiatives.
So Joel has been here before.
That why I believe he’s the man for this new battle.

The state supreme court will make its’ decision on this on August 9, 2024.
