The Democrats gutted the Parents Rights Initiative this session.

There are 2 ways for the voters to restore those sacred rights — with an initiative or with a referendum.

1) INITIATIVE. Superstar Brian Heywood filed just such an initiative on April 8, the AG gave it a ballot title on April 15, opponents challenged the title on April 22, and the judge will decide on the final wording for the ballot title on May 16. Only then can petitions be printed. He would then have 48 days to collect 308,411 valid voter signatures to qualify for a public vote in November (July 3rd is the deadline). By way of comparison, last year’s Natural Gas Initiative qualified in 44 days.

2) REFERENDUM. I filed Referendum 108 on the earliest possible day April 28. The Constitution guarantees 90 days to collect 154,206 valid voter signatures to qualify for a public vote in November (July 27th is the deadline). Since a referendum offers more time and requires fewer signatures, it is obviously a better option if not interfered with.

But that’s exactly what Secretary of State Steve Hobbs did.

Despite longstanding state law requiring him to transmit the referendum to the Attorney General for a ballot title, he refused.

So last week, I filed a Recall Petition against him for violating his oath of office by not following the law.

Earlier today, Hobbs was served:

We’ll be in court soon — I’ll let you know when.

Also last week, I filed a lawsuit called a Writ of Mandamus which is a court order that commands a government official to perform an act they are legally required to perform as part of their official duties (which is clearly the case here).

I’ll let you know when the state supreme court will hear it.

Since I’m not a lawyer, as you can imagine it took me all last weekend and the rest of this week to put this all together.
