As I explained in Tuesday’s update (click here to read it), a liberal activist named Arthur West recently filed a lawsuit that would strike down the Democrats’ law that allows the AG to sabotage any tax initiative by rewriting its ballot title, including the title for Brian’s No Income Tax Initiative. If you haven’t read it yet, please do (click here to read it) — it’s impressive legal scholarship (IMHO).

2 days again, on Tuesday, Brian Heywood’s attorney filed a separate lawsuit that asks that the wording be changed. It’s brilliantly argued.

Here’s my favorite part:

“The (the sentence inserted into the initiative’s ballot title) is not intended to describe a future hypothetical impact on a future hypothetical budget that will never take place if the initiative goes into effect. … The Attorney General’s Office chose a hypothetical impact to a future state budget not in existence …

The AG’s sentence “reflects the faulty and factually impossible scenario in which the income tax is presupposed to be currently in effect and before any taxes are ever collected. … The initiative’s only effect on the current state budget would be to save the State an unknown amount of the funds appropriated to the Department of Revenue to plan … future administration of the tax.

In order “to reflect the initiative’s actual impact … the (sentence) should be revised as follows: ‘This measure would increase funding for the 2026-2027 state general fund, which primary investments are medical assistance-programs, public instruction, and higher education.’

“Any other description would be inaccurate and mislead voters.

“Let’s Go Washington respectfully requests that this Court … give voters accurate information about the measure which they are being asked to vote.”

The brief makes totally logical arguments on why the wording of that sentence should be changed to reflect reality.

Again, this is a different approach than the other lawsuit.

We just need one of them to succeed. 

The hearing is scheduled for Fri, Aug 7th at 9:00am (hope you’ll join me to watch it live). It’ll be at Thurston County Superior Court, 2000 Lakeridge Dr SW, Olympia.

At the hearing, the first thing the judge will take up is Heywood’s lawsuit against the AG which, again, seeks to change the wording. 

Once that concludes, the judge will take up West’s preliminary injunction motion which, again, seeks to prohibit any change to any tax initiative’s ballot title, including Brian’s. 

This is a REALLY big deal so I’m going to do all I can to keep you updated on it.

On the court’s website, I learned the case was originally assigned to a recent Ferguson appointee but he was asked to recuse himself.

So it looks like it’ll be assigned to a different judge. When I find out which judge, then I’ll be able to provide everyone with instructions so you can watch it live online (if you can’t join me & watch it in person).

And if the Lynnwood Times sends their camera crew …

… I’ll be able to send everyone a YouTube video of the hearing after-the-fact.
