The AG and the Secretary of State have been lying to the court.

In their Answer to Arthur West’s lawsuit, they wrote: “The Secretary requests that this Court issue a decision no later than August 11 to ensure time for translation and ballot preparation.”

Sounds like a solid deadline, doesn’t it?

But weeks ago, I emailed Stuart Holmes, the Director of Elections at the Secretary of State’s office:

“Stuart, in 2018, this appeared in a court filing: Eyman v Wyman in 2018 — ‘Secretary Wyman has indicated, however, that she needs a ruling by August 31, 2018, to ensure that ballots are timely delivered to military personnel overseas.’ What is the comparable date for 2026?”

His response: “Tim, the Primary results are certified on August 21st and we’d be looking for a decision ASAP after that date if not on that date.”

So not the 11th, the 21st.

A few weeks later, I asked him again: “Please clarify: what is the actual drop dead date that your office would need to receive a final decision from the Court on whether or not to include that extra sentence in the initiative’s ballot title?”

He responded: “We’d need a final decision from the Court by August 21st on whether or not to include the public investment impact disclosure.”

BUT I’VE SINCE LEARNED THAT THAT’S A LIE TOO.

I called and talked with 2 county auditors and they both confirmed that each county prints its own ballots.

So I emailed several county auditors and asked each of them what their ballot printing deadline is: 

PIERCE COUNTY: “The state tells us what to place on the ballots for state measures and candidates. If a judge tells us to remove something by the end of the day on the 4th (of September) we can make that happen.”

KING COUNTY: ” … ballots are due to our print vendor by September 10th in order to meet our legal mailing deadlines.”

SNOHOMISH COUNTY: “Our ballot packet vendor is K&H Printers, and our ballot files are going to them on September 9 with our approval of proof files on Sept 14th.”

MASON COUNTY: “9/9”

YAKIMA COUNTY: “K&H prints ours on 9/12”

It’s clear that August 11 and August 21 are both lies.

Why would the Secretary of State and Attorney General blatantly lie to the Court about when a decision must be made?

Because they want to …

They want an expedited briefing schedule because that makes it much, much tougher on the challenger and almost impossible for anyone else to intervene and participate.

And it gives the Court the impression that there’s not enough time to have oral argument which robs the public and the press of the opportunity to learn what’s going on. 

They want to get the spotlight off this as soon as possible. 

I urge EVERYONE to send an email to the state supreme court.

King County’s ballot print deadline is Sept 10, Pierce Sept 4, Snohomish Sept 9, Yakima Sept 12, Mason Sept 9. Please give the parties plenty of time to draft their briefs. Please give other interested parties time to intervene and participate.  Please give the public and the press the opportunity to learn what’s going on by having oral argument. Liberal activist Arthur West is challenging the constitutionality, legality, and neutrality of a law the Democrats passed in 2022 that empowers the AG to insert a sabotage sentence into the ballot title for any tax initiative that qualifies for a public vote.

Including superstar Brian Heywood’s No Income Tax Initiative.

Last Friday, the lower court judge went completely nuts (and no, I don’t believe he was on drugs as many have suggested). 

It was widely reported that West was going to file his appeal with the state supreme court on Monday.
