Stopping the Democrats Income Tax Bill, 50k CITIZENS SIGNED

I’M VERY OPTIMISTIC THE DEMOCRATS’ NEW INCOME TAX WILL NEVER TAKE EFFECT. It’s getting attacked on multiple fronts by smart, committed, persistent heroes. Each battle front reinforces the others.

About a year ago with a group of young girls, my daughter Riley led a discussion with them about how to handle any challenge that confronts you in life. In a nutshell, the topic was “You can look at things 2 ways, as a bad thing and be depressed or as an opportunity and be happy.”

She said she opened with: “This is an easy for me to talk about because I was raised by a dad who is annoyingly optimistic.”

It’s absolutely true — I can’t help but see the positive in everything that’s happening around me, including our fight to stop any kind of income tax gaining a foothold in Washington state.

* First and foremost, when the Democrats were pushing the bill in Olympia this year, they were forced to pretend that the 100K+ citizens who signed in CON were “bots”. 

* To survive the inevitable court challenge against it — which is happening right now with uber-brilliant attorneys Rob McKenna & Phil Talmadge — the Democrats are being forced to make the absurd argument that your income is not your property:

With 100 years of legal precedent on our side (where the court’s have ruled your income is your property), I’m becoming more and more optimistic that no matter how corrupt the judges on the state supreme court are (and they certainly are), it’s going to be very, very tough for them to justify that your income is not your property.

This is especially true because the high court’s unanimous ruling on the capital gain tax. In it, they said “the legislature called it an excise tax, the legislature never called it an income tax, and so we’re going to rule it’s an excise tax.” In the Democrats’ income tax bill, they specifically named it an income tax, not an excise tax. 

So that’s one battle front and there are many reasons (those that I just mentioned and many more) to be optimistic about it.

Then there’s the battle front over the public vote this November.

Superstar Brian Heywood filed a referendum to let the people decide. He did that knowing that the high court was going to stick with precedent and rule that the legislature declared it an emergency making it referendum-proof. But Brian got what he wanted because in their ruling, they said they weren’t going to overturn a multi-decade legal precedent (which boxes them in when they’ll be issuing their ruling on the 100 year precedent that income is property).

But he didn’t stop there (the guy is relentless).

He followed up and filed an initiative. And he and his attorneys drafted it very smartly:

* It prohibits the state and all local governments from imposing any tax on any individual’s income at any income level (this benefits every taxpayer, not just the successful. NO ONE wants an income tax to hit THEM).

* It repeals only those parts of the Democrats’ bill that imposed the new income tax. It DOES NOT REPEAL the tax relief it provides. So it only gets rid of the tax increase, none of the tax reductions. This is very shrewd.

* Thanks to Brian and ALL OF YOU, in just 51 days over a half a million voters agreed to stop all income taxes …

* That is DEMONSTABLE PROOF that there’s overwhelming public opposition.

* As soon as the AG tried to sabotage the ballot title for the initiative, 2 separate lawsuits were filed to reverse it, one by Brian Heywood and one by a liberal activist named Arthur West. Both briefs are brilliantly argued so there is every reason to believe one of them will be successful.

* Whenever the people have been asked to vote on allowing the government to impose a new income tax, voters have rejected it 10 times. The last time, in 2010, 65% of voters voted no and only 35% voted yes.

* The vote on Brian’s No Income Tax Initiative is Nov 2026. The tax doesn’t tax effect until 2028. So if for whatever reason a majority of voters don’t pass this initiative, we have all of 2027 to try again.

* Over the past 3 decades, I’ve learned that voters are very open to reconsidering their ballot box decisions when circumstances change and/or a new initiative addresses the concerns the voters raised about the previous initiative.  

I’m never going to give up on this.

And I’m absolutely POSITIVE that the same smart, committed, persistent heroes fighting against this now will never give up either.

Together, we can accomplish anything as long as we stay strong, have faith, and remain positive and united.
