Fighting for taxpayers for 29 years

During the 2022 legislative session, to protect the newly created capital gains tax and all future taxes, the Democrats passed a law sabotaging any tax initiative. 

Brian Heywood’s initiative is a tax initiative.

So it’s been sabotaged by that 2022 law.

On July 23, the Attorney General sent the Secretary of State a sentence that was actually pre-written by the 2022 Legislature — it begins with 6 words that are mandatory: “This measure would reduce funding for” followed by 15 words that the 2022 Legislature required the AG to write which simply list the 3 highest funded government services in the general fund.

It doesn’t matter that the Democrats’ new income tax never collects a dime until April 2029 and it doesn’t matter that Brian’s initiative does not (and could not) require cuts to those top 3, their mandated wording must be used.

So to be clear: it really isn’t the AG who wrote the sentence — it was the Democrats in 2022 who required it be worded that way.

Back in May, after Brian’s No Income Tax Initiative was filed, the Attorney General reviewed it and issued a description of its policies (the official ballot title):

Initiative Measure No. IP26-645 concerns state and local taxes. This measure would repeal a 9.9% tax on annual individual income over $1,000,000; prohibit taxes measured by individual income and taxes on individual income or the receipt of individual income; and define “income.”

That’s the description that was printed and appeared on the front of the petitions that we all circulated:

And that’s what 511,408 voters signed on to:

Fortunately for us, Initiative Superstar Brian Heywood & a liberal activist named Arthur West are fighting to reverse the AG’s sabotage of the initiative.

Brian’s lawsuit asks that the wording be changed — it’s very well argued (click here to read it).

Only one of them needs to succeed.

And whichever way it goes, it’ll be appealed to the state supreme court and be decided on August 21st.

This is a REALLY big deal so I’m going to do all I can to keep you updated on it.
