OVERTURNING THE INCOME TAX (BATTLE FRONT #1: CHALLENGING THE LAW IN COURT). Lawsuit announced today. I watched it live (there’s a link below if you want to watch it yourself). Thrilled they’re doing it, great team, great arguments, great strategy, but …

Because the Democrats’ Destructive Income Tax is such a mortal threat to the very foundation of our state’s economy, no stone can be left unturned.
The good news is the good guys understand this and are attacking it on ALL FRONTS.
They’re just not EXPLORING every option.
They’re IMPLEMENTING every option.
They’re not using a sniper rifle …

They’re using a shotgun:

We only need one of them to hit the target to get it overturned.
Today, the good guys announced BATTLE FRONT #1: CHALLENGING THE LAW IN COURT.
This morning at 10am, there was a press conference on ZOOM — I watched it live — where the superheroes at the Citizen Action Defense Fund (CADF) announced their lawsuit challenging the legality and constitutionality of the Democrats’ Destructive Income Tax (Engrossed Substitute House Bill #6396).

This is a great organization that’s been around for years and is led by a very smart, savvy attorney Jackson Maynard (he was also in Olympia when Ferguson signed the bill):

They announced today that former Attorney General Rob McKenna …

… and former Democrat legislator and former state supreme court justice Phil Talmadge …

… are teaming up for this.
QUICK ASIDE: at the Seattle City Club in 2001, Rob joined me and debated against opponents of our 1% property tax initiative (I-747). And at the Seattle City Club in 2002, Talmadge and I debated against each other on our 2nd $30 Tabs Initiative (I-776):
Anyway, McKenna and Talmadge are both very experienced, brilliant attorneys.
They know their stuff.
During their 46 minute presentation (click here if you want to watch it), they laid out — in a very understandable way — the reasons why the Democrats’ Destructive Income Tax is illegal and unconstitutional. I found the Q&A especially informative.
For their lawsuit, they have a long list of individuals and organizations as plaintiffs but the lead plaintiff is the Yakima / Klickitat Farm Association so it was filed and will be heard in Klickitat County Superior Court.
When I get a copy of it, I will make sure to send it out.
ATTACKING THE INCOME TAX ON MULTIPLE FRONTS IS THE BEST WAY TO GO.
So again, I’m thrilled they’re doing this lawsuit because in addition to the getting the law struck down, it educates the public about how corrupt Ferguson and the Democrats are.
Will they win their lawsuit?

They should.
And it’s possible they will.
Just like in baseball — you’ll never hit the ball unless you swing at it.
They’re swingin’ at it.
And they deserve our appreciation and support for doing so.

And don’t be concerned — the good guys aren’t putting all their eggs in the litigation basket.
As I often say: I’d rather be optimistic and later be proven wrong then to be pessimistic and be proven right.
As always, I welcome your feedback.
For 29 years, I’ve been fighting for the people of our state and our nation.

I urge you to help me fight back against Bob Ferguson’s abuse of power by donating to the Tim Eyman Legal Defense Fund so Richard Sanders and the Pacific Legal Foundation can get the AG’s ridiculously unconstitutional ruling overturned.
