STUNNING VICTORY IN COURT ON FRIDAY — JUDGE SIDES W/ SHERIFFS & OUR CONSTITUTION: thanks to superstar attorneys Mark Lamb and his team (as well as rock star lawyer Joel Ard), our right to vote for our local sheriff is now PERMANENTLY secure. Many of you joined me there to witness history (both in person and online). If you missed it, below is a link so you can watch it (special thanks to the Mario Lotmore’s Lynnwood Times and his videographers / photographers Dana & Joe for making the complete video available to all). A few months ago, the Court TEMPORARILY upheld our rights … on Friday, the Court made it PERMANENT.

JUSTICE PREVAILED IN A WASHINGTON COURTROOM.
Ya, I know, that’s hard to believe.

But that’s what happened in Olympia on Friday.
And we have a handful of heroic people to thank for this tremendous victory (this was taken after the court ruled that the Democrats’ law attacking our right to vote for our local sheriff was unconstitutional — it’s a great picture of the sheriffs and their attorneys who fought and won for all of us).

Too often, too many of us say “WHY TRY?”
The answer to that question is simple: because that’s what our opponents want — for us to stop trying.
Because as long as you’re still swinging, the fight ain’t over.

That’s why this resonates so much with me:

Friday’s hearing started at 9am.
As promised, I showed up at 8:30am.

By the time the 9am hearing started, we had packed the courtroom:

And MANY more of you were watching it online (the list you see on the right only shows names starting w/ A through C!!)

Wayda go!
We had front row seats to watch history being made:

First up, superstar attorney Mark Lamb calmly and methodically highlighted the law’s many legal and constitutional flaws:

“The First Amendment and democracy requires that the people may sometimes elect someone we don’t like, and elected officials, as they frequently do, may say things that we don’t like. And the remedy for that is not to have an unelected commission remove them from office any time they say something the commission determines is offensive or impermissible.”
Obviously, the Dems’ aren’t big believers in Voltaire.

Then it was the AG’s turn and the main argument was the Democrats’ law should be allowed to take effect and if the Commission removes a sheriff who was elected by the people, then that sheriff can challenge the law then. In court parlance, the AG argued these sheriffs didn’t have “standing” (hadn’t been harmed yet) and so only an “as applied” challenge was appropriate.

During his 10 minutes of rebuttal, Mark crucified that weak argument.
When he was finished, the judge had a brief recess and then came back and gave her ruling from the bench. For the next hour and 15 minutes (gulp!), she explained her reasoning and rationale for her decision.
There’s a link below that you can click on to watch the whole thing.
But to help you navigate through it, here are the time stamps so you can fast forward to the “good stuff”:
From 03:29 to 16:06 — you can listen to Mark Lamb’s opening arguments (great stuff)

16:15 to 34:51 — AG’s defense (not really worth your time)

35:06 to 42:27 — you can listen to Mark’s spectacular rebuttal.
42:27 to 51:12 — More procedural stuff — not worth your time — skip forward to the 51:52 mark
51:12 to 2:03:35 — Judge issues her VERY COMPREHENSIVE ruling (it lasts 1 hour and 12 minutes):

Again, use the time stamps above to navigate through it.
The Center Square published a very thorough news story about it — you can read it by clicking on this image:
After she issued her ruling left the bench, we all had the same feeling:

Because our constitutional rights were upheld.
Again, here’s a picture of the heroic people who fought for our rights and won:

As always, I welcome your feedback.
For 29 years, I’ve been fighting for our state and our nation.
Is it any wonder Bully Bob Ferguson is trying so hard to impose a lifetime ban on all my future political activity?

I implore you to support the Tim Eyman Legal Defense Fund so Richard Sanders and the Pacific Legal Foundation can get the AG’s ridiculously unconstitutional ruling overturned so we can make sure what Ferguson has done to me and my family never happens to anyone else ever again.

The only reason I’m still here and I’m still fighting is because of the prayers, love, and support of wonderful friends like you who’ve seen this gross injustice and abuse of power and are willing to help.

I love you all.
Onward!
Tim
