YESTERDAY’S UPDATE WAS INCORRECT. Both lawsuits are NOT being heard at 9:00am. There are 2 separate lawsuits before 2 different judges at 2 different times on Friday. Yesterday I said both were at 9:00am – sorry for the mistake.

At 9:00 am on Friday, liberal activist Arthur West will argue before Judge Chris Lanese and is challenging the constitutionality of the Democrats’ anti-initiative law (you can read it here) that empowers the AG to add a sabotage sentence to the ballot title for Brian’s No Income Tax Initiative.

West is asking Judge Lanese to prohibit the Secretary of State from including that sabotage sentence in the initiative’s ballot title which will be printed on voters’ ballots and mailed out in November.

Here are details on Friday’s 9:00am hearing:

It’s at Thurston County Superior Court, 2000 Lakeridge Dr SW, Olympia in Judge Chris Lanese courtroom which is on the 2nd floor (Room 202). It starts at 9:00am so I’ll get there around 8:30am.

It makes a huge difference when there’s a packed courtroom so I hope you’ll join me there to watch it in person.

Judge Lanese will hear West’s constitutional challenge sometime between 9am & 11am (hearing ends at noon).

Oral argument will last an hour and after that, the judge will rule on West’s Preliminary Injunction motion.

Regardless of the judge’s decision, it will be immediately appealed to the Court of Appeals (Division 2) or to the state supreme court by the losing party.

Friday @ 1:30pm, Judge John Skinder will hear legal challenges to the wording of the sabotage sentence the AG wrote.

Heywood’s attorney Callie Castillo …

… in her opening brief asks the judge to change the wording that will be inserted into the initiative’s ballot title (NEW: you can read her Reply to the AG by clicking here).

The No on 645’s attorney will also ask for new wording. 

Liberal activist Arthur West will argue against adding any sentence to the initiative’s ballot title.

This hearing will start promptly at 1:30pm because it’s the only case.

Judge Skinder will hear oral arguments from Heywood’s attorney, the No campaign’s attorney, and liberal activist Arthur West.

Then he will decide the wording of the sentence. 

And unlike the other case, JUDGE SKINDER’S RULING IS FINAL AND IS NOT SUBJECT TO APPEAL.

These legal challenges are a REALLY big deal so I’m going to do all I can to keep you updated on them.
